Generation YES Privacy Statement, effective October 18, 2000.

This Privacy Statement describes, among other things:

  • The personal information, including cookies, that Generation YES collects from users of Generation YES and affiliated sites and how Generation YES uses and discloses such information.
  • The responsibility of schools for obtaining parental consent for such collection, use and disclosure of the personal information of their students.
  • The protections employed by Generation YES in safeguarding such personal information.

This Privacy Statement is a legal notice regarding these and other privacy matters.  It applies to all websites affiliated with Generation YES, inc., except as otherwise stated in those websites.

Introduction
In connection with the registration of users ("Users") of the Generation YES website,  and subsequent use of the Site, Generation YES, inc.  ("Generation YES") collects information from and about registered Users and uses and discloses such information in a variety of ways, as described below.  Users should read this Privacy Statement to understand what information may be collected if they choose to register, how the information may be used, what measures are taken to protect the information, and how Registered Users can change or delete information relating to them.

Registered Users fall into four categories: Registered Schools, Registered Teachers, Registered Students and Generation YES Staff.

Registered Schools:
A Registered School is a bona fide, lawfully accredited institution of primary, secondary, higher education in the United States or abroad that has been registered for the Site by a teacher or other authorized representative (the "Teacher").  Upon registration, the Teacher must provide information to complete the Registered School's Profile, which contains, among other things, the first and last name of the Teacher, the street address and telephone number of the Registered School, and the e-mail address of the Registered School or the Teacher.  As part of the Profile, the Teacher must also choose a password for the Registered School (a unique School ID number is assigned by Generation YES) .

Generation YES does publicly post information on member schools. Specifically the information released is the School�s name, district, address, city, state or province, zip code, country, phone and fax numbers. Additionally the name and e-mails of any teachers at the School is also publicly available.

Registered Teachers:
A Registered Teacher is an individual who is reciginized as a member of the faculty or staff of a Registered School. Upon registration the teacher provides Generation YES with their first and last names, e-mail address, phone number, and certain preference information.

Generation YES does publicly post the teacher�s name and e-mail address on that teacher�s school listing.

Registered Students:
A Registered Student is a student who attends a Registered School and who uses the Site under the supervision of and as authorized by the Registered School.  Registered Schools are responsible for controlling the information that Registered Students provide to Generation YES in connection with registration, which consists of the student's name, password, e-mail address, and grade. Registered Schools may also allow to disclose information by participating in a chat room, bulletin board or a threaded discussion or disclose information using other open-ended communications technologies.  Because chat rooms and bulletin boards and such other Internet technologies are capable of displaying any information whatsoever, information of any type can be posted by the Registered Student including personal, sensitive or confidential information.  By allowing students to register on the Site, Registered Schools authorize Generation YES to collect such personal information from Registered Students and to use and disclose such information as described in this Statement.  Generation YES does not and will not obtain consent from parents for the collection, use, or disclosure of information collected from students who register under the supervision of Registered Schools. The Registered School in which the student is enrolled is responsible for obtaining this permission from the student�s parent.



Cookies:
Generation YES also places small files known as "cookies" on the hard drives of its Users.  Generation YES�s cookies reflect identifying information about each User and retain certain information about the User�s use of the Site.  These cookies are accessible to Generation YES as Users browse Generation YES, and may be accessible to other websites as Users browse those sites.  Generation YES uses a form of encryption with the intent of masking the meaning of such cookies to websites not affiliated with Generation YES, but the privacy of such information cannot be guaranteed.  Generation YES does not enter agreements authorizing unaffiliated entities to access the information in Generation YES�s cookies.

Generation YES additionally uses cookies with unregistered Users, although Generation YES has no basis for associating the cookie-based information for such Users with those Users� personal identities, which remain unknown to Generation YES as long as the User remains unregistered.

Use and Disclosure of Information; Reasons for Collection of Information:
Generation YES uses information collected from Users to personalize services on the Site.

Any information that a User posts to the Site may be viewed by persons who are granted access to such areas of the Site. Although Generation YES makes commercially reasonable efforts to control access to web pages in accordance with the preferences of Users, all Users should understand that the content of any information posted to the Site may be viewed by members of the public.

Generation YES may disclose personal information collected from a User to Generation YES's affiliates and partners for their internal use.  Generation YES does not otherwise disclose information about a User to unaffiliated third parties (apart from the disclosures made on the Site described above) unless (1) the User expressly authorizes Generation YES to disclose such information, (2) Generation YES is required by law to disclose such information, (3) Generation YES aggregates such information with information of other Users from which the certain data field(s) that Generation YES believes constitue or create personally-identifiable information have been removed, or (4) Generation YES in its sole discretion elects to disclose such information in connection with claims of copyright infringement or other unlawful acts associated with the User�s use of the Site.  Registered Users may also choose to receive e-mail notices from Generation YES about new and updated features of the Site. Information about a registered User that is contained in the User�s Profile will be disclosed to and may be modified by anyone possessing the User�s user name and password.  

Generation YES will use cookies to authenticate registered Users, to assist in the navigation of the Site, to personalize the Site for Users, to control access to Site content; and Generation YES may, in its sole discretion, use cookies for all other technologically possible uses of cookies.

By registering for and/or using the Site, each User consents to all of the foregoing uses of User information, and consents to all other uses of such information reasonably necessary to facilitate such uses, including but not limited to trans-border transmission of such information worldwide.

Protection of Information
Information collected from Registered Users is stored on databases and other servers kept in secure locations under the custody and control of Generation YES or its third party hosting services.  Generation YES also uses technologies and processes such as encryption, access control procedures and network firewalls to protect such servers.  User accounts and Profiles are password-protected using industry-standard, commercially reasonable methods.  Generation YES makes commercially reasonable efforts to protect such information and to limit its use and disclosure as described herein, but cannot guarantee that such efforts will be successful.

Changing or Deleting Information
Registered Users (other than Registered Students) may make changes to their Profiles at any time by accessing their Profiles with their password.  Registered Students and Registered Parents may make changes to their Profiles and web pages as authorized by the Registered School.

Registered Schools may delete their Profiles or the Profiles of affiliated Registered Students or Registered Teachers by sending a request to [email protected].  

Revision of Privacy Statement
Generation YES reserves the right to change this Privacy Statement at any time without notice and with immediate, retroactive effect on all User information previously collected.  Each User agrees to review the Site regularly for changes in the Privacy Statement, and agrees to consent in advance to such changes or, if he or she does not consent to any provision in any Privacy Statement that supersedes this Privacy Statement, agrees to delete his or her User Profile and/or terminate his or her registration.  Generation YES will post a notice of any material change in this Privacy Statement on the Site.

Other Websites
The Site links to a wide variety of other unaffiliated sites.  Generation YES is not responsible for the privacy policies of those other sites or how they treat information about their users.
